The visible symbol embodying our Nation


Shoot if you must, this old grey head, but spare your country's flag

On April 14th 2005 Senator Orin Hatch proposed an amendment to the Constitution. Previously, (last Sunday) I predicted that this amendment 'will pass'. It is possible that we will see this come to pass any day now. I pray I am correct.

The
28th Amendment to the US Constitution will read concisely, " The Congress shall have power to prohibit the physical desecration of the flag of the United States. "

Currently we have 65 votes in favor of the proposal to amend the Constitution banning the desecration of the American flag. We need only two of the remaining three Senators to vote in the affirmative. The other requirements have been met, the House passed it in June 2005 and since then 'ALL' fifty States adopted a similar resolution protecting the flag.




The ACLU and many on the far Left are crying foul and claiming such an amendment is censorship. This amendment is NOT in anyway censorship. Yet the ACLU's Caroline Fredrickson said, " The right to voice a dissenting view point no matter how unpopular is a bedrock principal of America". That is true, but absolutely nothing about this proposal that will censor speech. It would simply regulate the way the view point is expressed. Congress has regulated the way free speech is expressed in many instances, and retains the right to regulate the way the flag is treated, displayed etc. If you hate America and all it stands for you can run down the street screaming 'I hate America' and 'Capitalist pig die" just as long as you don't desecrate our flag, or any of our national monuments in the process.
In his dissenting opinion in
Texas vs. Johnson (opinion text), Chief Justice William H. Rehnquist wrote,
"The American flag, then, throughout more than 200 years of our history, has come to be the visible symbol embodying our Nation. It does not represent the views of any particular political party, and it does not represent any particular political philosophy. The flag is not simply another "idea" or "point of view" competing for recognition in the marketplace of ideas. Millions and millions of Americans regard it with an almost mystical reverence regardless of what sort of social, political, or philosophical beliefs they may have. I cannot agree that the First Amendment invalidates the Act of Congress, and the laws of 48 of the 50 States, which make criminal the public burning of the flag."
When Rehnquist went on to say that irreverent burning the flag is, "no essential part of any exposition of ideas" but rather "the equivalent of an inarticulate grunt or roar that, it seems fair to say, is most likely to be indulged in not to express any particular idea, but to antagonize others."

The late Rehnquist has said it best.

You are right Mama, as usual. the only thing is, unfortunately, that when you said Law makers and judges you were being repetitive. Our Judges have become lawmakers and THAT is why we have to fight for this amendment in the first place. If the Supreme court had not ruled against the clear wishes of the people. The laws we had on the books prior to Texas v. Johnson would have prevented this issue from ever being debated, but activist judges forced the hand of the people and we MUST respond.

i tried to burn a flag once when mr. bush said that we were fighting in iraq 'to protect the american way of life.' the made-in-china polyester flame resistant fabric (petroleum based fabric) would not burn, it just kind of melted. the current american way of life=hatred, fear, consumption and greed. nothing remotely close to the principles on which the nation was founded, let alone the fruits of the spirit.

you see, i see the american way of life as one that respects every person on the planet's right to (1) live, (2) be free from someone else telling them what to do, e.g., have liberty, and (3) pursue happiness, however that individual defines it.

so respect what? respect god ... well, he gave us the the 10 commandments, and we are violating almost all 10 of them right now with the current administration and this war "on terror". most "Christians" do not even know what "sabbeth" means ... they think its a day of the week.

respect parents ... if you respect a child, they will learn respect.

the laws ... well, we've already desecrated our founding principles, so the "law" means nothing because the spirit of the law has been erased and ignored by our judicial system.

'elders' ... my elders taught me to follow the 10 commandments, follow jesus' teachings and love your fellow man even if it means you have to sacrifice everything about your life, including life itself, to show how much you love them and my god.

the flag means nothing ... its a symbol and only can have the meaning if the principles for which it stands is honored. god doesn't have a flag ... and if he did, it would be the rainbow promise he gave to noah.

Yes David, I think you and Elaine have much common ground. You can articulate complete discontentment and animosity toward people who serve and protect you and towards the fantastic nation that affords you rights to think as twistedly as you wish; rights not enumerated by the enemies of this nation that you seem to side with. I spent a couple thousand words voicing my opinion on this subject throughout three posts. Every wrong minded comment left by you and Elaine on these posts have been answered within.
I can say this, when it comes to originality of thought and articulation, Elaine dwarfs you my dear Liberal friend. But keep on trying, you won't be out witted by girls forever:)
